A person pronouncing divorce can be taken to task

Often it happens in dramas that if a husband likes to give divorce, he just pronounces divorce 3 times to his wife and the relationship ends. Often it is also shown that a husband visits a lawyer, helps him in preparing divorce papers and when the same are sent to wife, the relationship ends.

Legally that is not the case. It is true that Sharai divorce can be pronounced verbally or through divorce papers. However, legally speaking there is a procedure for divorce which a husband is bound to follow in case if he divorces his wife. That procedure is mentioned in section 7 of the Muslim Family Laws Ordinance 1961.

According to section 7 the procedure lasts for 90 days. In such procedure there are practically atleast three hearings for reconciliation between parties. If the reconciliation fails on final hearing, the case results in divorce after the completion of iddat period. If a husband does not follow the procedure mentioned in Section 7 then he can be penalized for fine and imprisonment both.

At the end of procedure two divorce certificates are issued in favor of each of the parties. For more you can consult lawyergolra@gmail.com

Legal Notice often save houses from breaking up

Legal notice is a notice given to the opponent party by a lawyer on behalf of his client. It has legal language well equipped with proper course of action to be adopted in case if grieviance of aggrieved person is not addressed.

A professional lawyer knows exactly how to deal in a specific case. In family cases legal notices often save houses from getting broken. The reason is that a legal notice clearly shows the other partner that if he or she will not settle the dispute, the matter may be taken to the court of law.

People who avoid litigation or who do not want to spoil their reputation come to the talking terms for settling the dispute once legal notice is received by them. In such like situations mostly disputes are settled outside the courts even without filing of cases.

We offer mediation, arbitration and all kinds of legal services to our customers according to the situation of the case. Do consult at lawyergolra@gmail.com if you have an unresolved matter at hand.

Difference between Khula and Divorce

Divorce is the right of man while khula is the right of woman. A man can divorce his wife while a woman can take khula from her husband. The man can exercise his right directly while a woman cannot be granted khula unless the Qazi (Judge) is satisfied.

There are few grounds of Khula which include non maintenance of husband, impotency, cruel treatment, leading the wife to immoral life, etc.. Above all these grounds it is settled principle that if a wife hates her husband then hateful union cannot continue and Khula is usually granted on this ground.

A wise lawyer knows exactly which grounds to apply and which not to invoke in a particular case of khula. Similarly if a man exercises his right of divorce, he has to follow the legal procedure of divorce as mentioned in section 7 of Muslim Family Laws Ordinance 1961.

Divorce does not happen merely through preparation of papers

Sharai divorce happens even if its pronounced verbally. However, legally a person has to file case of divorce for obtaining divorce certificate. The case runs for 90 days with atleast 3 hearings for arbitration. If the arbitration process fails on all hearings then the case ends up in divorce.

If one party files the case and the other party does not appear then at the end of case a newspaper proclamation is published before the issuance of divorce certificate.

A divorce case is normally filed under section 7 of the Muslim Family Laws Ordinance 1961. However, under section 8 the wife can proceed if she has the right of talaq e tafweez according to column 18 of the Nikahnama. Wife can also file case of divorce in case if divorce papers are sent by the husband.

Divorce is not possible during pregnancy

A Muslim woman cannot be divorced during pregnancy. If a husband pronounces divorce to his wife during pregnancy, it is immaterial till delivery. However, if after delivery of child, it is not reconciled within 90 days, it becomes divorce.

The reason is that the Iddah of a Muslim woman is 90 days after pronouncement of divorce by the husband. If divorce is pronounced to a Muslim wife during pregnancy, it becomes effective automatically after the end of pregnancy. The iddat of such lady starts from that day and if the divorce is not revoked in such time period of 90 days, then it becomes complete divorce.

Once a women completes her Iddat after divorce, it means the divorce is final and irrevocable between parties. For more information you can contact lawyergolra@gmail.com
